Due to the current economic conditions and the inflationary environment in Turkey, the number of disputes between tenants and landlords is increasing every day.
As a result, in recent times, there have been numerous disputes regarding rents between landlords and tenants. And one of the pressure tactics to increase rents by more than 25% (the legally required limit) is the threat of selling the property to a third party.
HOWEVER, if the tenant refuses to show the property, the only solution is to initiate legal action by requesting a court to order an inspection. Otherwise, no one can view the property you are renting. This legal action is governed by Article 319 of the Turkish Civil Code and pertains to the presentation of the leased property. In Istanbul, these cases typically last approximately 24 months, including the appeals process. In other words, it will take 24 months before the tenant shows the property, and the landlord can then sell it.
So, the law and practice favor tenants. This means that in rent negotiations, the tenant holds the advantageous position.
